General terms and conditions of sale

Introduction

The present conditions of sale aim at defining the contractual relations between Poulo-Condor and the purchaser and the conditions applicable to any purchase carried out by the means of the Internet site Poulo-Condor. The acquisition of a product through the present site implies an acceptance without reserve by the purchaser of the present conditions of sale of which the purchaser recognizes to have taken knowledge before his order. Before any transaction, the purchaser declares on the one hand that the purchase of products on the Poulo-Condor site is not directly related to his professional activity and is limited to a strictly personal use and on the other hand to have the full legal capacity, allowing him to commit himself under the present general conditions of sale.

The Poulo-Condor site operated by the company Alps Spirits SA retains the possibility of modifying these terms and conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force at the date of the order by the buyer.

Products

The products offered are those which appear on the Poulo-Condor site of the company Alps Spirits SA within the limit of available stocks. The Poulo-Condor company reserves the right to modify the range of products at any time. Each product is presented on the Internet site in the form of a description taking again its principal technical characteristics (size, visual...) The photographs are as faithful as possible, but do not engage the salesman. The sale of the products presented in the Poulo-Condor site is intended for all the purchasers residing in the countries which fully authorize the entry on their territory of these products.

Rates

The prices appearing on the product sheets of the internet catalogue and are prices in CHF all taxes included (VAT included) taking into account the VAT applicable on the day of the order and the delivery costs for Switzerland and Europe. Any change in the VAT rate may be passed on to the price of the products. The Poulo-Condor company reserves the right to modify its prices at any time, it being however understood that the price appearing in the catalogue on the day of the order will be the only one applicable to the purchaser.

Order and terms of payment

The buyer can order the products as a guest or register as a member and create an account on the Poulo-Condor site. The heading of creation of accounts is accessible directly from the menu bar of the site. At each visit, the purchaser, if he wishes to order or consult his account (order status, profile...), can identify himself as a member. The Poulo-Condor company proposes to the purchaser to order and pay for its products in several stages, with 2 payment options to choose from.

Secure payment by Paypal or credit card; the buyer selects the products he wishes to order in the "basket", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the method of payment of his choice: "Payment by Paypal". The next step is to check all the information, read and accept the present terms and conditions of sale by ticking the corresponding box, then invites the buyer to confirm his order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the secure interface PAYPAL or credit card in order to securely enter his Paypal account or personal credit card details. If the payment is accepted, the order is registered and the contract is definitively formed. Payment by Paypal account or credit card is irrevocable. In case of fraudulent use of the latter, the buyer may demand the cancellation of the payment by card, the sums paid will then be recredited or refunded. The responsibility of the holder of a bank card is not engaged if the disputed payment has been proven to be made fraudulently, remotely, without physical use of his card. In order to obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must contest the debit in writing with his bank within 70 days of the transaction, or 120 days if the contract binding him to the bank so provides. The amounts debited are reimbursed by the bank within a maximum period of one month after receipt of the written objection from the cardholder. No charges for the return of the sums may be borne by the holder. Confirmation of an order implies acceptance of these terms and conditions of sale, the acknowledgement of having perfect knowledge of them and the renunciation of the right to avail oneself of one's own terms and conditions of purchase. All the data provided and the recorded confirmation will be worth proof of the transaction.

If the purchaser has an e-mail address and if he has given it on his order form, the Poulo-Condor company will send him by e-mail the confirmation of the recording of his order. If the purchaser wishes to contact the company Poulo-Condor it can do it via the form of contact present on the site.

Retention of title

The Poulo-Condor company preserves the full and whole property of the products sold until the perfect collection of the price, in principal, expenses and taxes included/understood.

Withdrawal

The buyer has a period of 15 (fifteen) days (Saturday and Sunday not counted) from the delivery of their order to exercise his right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for the return costs. The product must not have been used.

Personalized articles: for the personalized articles, whose payment can be made outside the Poulo-Condor site, no retraction is possible once the invoice has been paid by the customer to the company Alps Spirits SA.

Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. The orders are carried out by any transport available by the Poulo-Condor company according to the products. The delivery periods are given only as an indication; if those exceed 10 days as from the order, the sale contract could be cancelled and the purchaser refunded. The purchaser is delivered to his residence by his factor. In case of absence of the buyer, he will receive a notice of passage from his postman, which allows him to withdraw the products ordered at the nearest relay, during a period indicated by the transport services, or wait for delivery depending on the decision of the carrier. The risks related to transport are the responsibility of the purchaser from the moment the articles leave the premises of the company Poulo-Condor or those of its supplier(s). The purchaser is held to check in the presence of the delivery person, the state of the packing of the goods and its contents at the delivery. In case of damage during transport, any protest must be made to the carrier within three days of delivery.

Warranty

In the event of nonconformity of a sold product, it could be turned over to the Poulo-Condor company which will take again it, will exchange it or will refund it, if the product is neither opened, nor deteriorated. The product must be turned over in the state which it received it, under penalty of losing the guarantee. All claims, requests for exchange or refund must be made via our contact form within 15 days after delivery.

Responsibility

The company Poulo-Condor in the process of distance selling, is bound only by an obligation of means. Its responsibility could not be committed for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, rupture of the service, or other involuntary problems.

Intellectual Property

All the elements of the Poulo-Condor site are and remain the intellectual and exclusive property of the company Alps Spirits SA. Nobody is authorized to reproduce, exploit, or use for any reason whatsoever, even partially, elements of the site, whether they are in the form of photo, logo, visual or text.

Dispute Resolution

These terms and conditions of distance selling are subject to Swiss law. For all disputes or litigation, the competent court will be that of the Canton of Geneva.
